Terms and Conditions

These Terms and Conditions govern access to and use of the Nijee online marketplace by visitors, customers, buyers, sellers, authorised business representatives and other users.

By accessing, registering with or using Nijee, you agree to follow these Terms and the policies referred to in them. Please read them carefully before creating an account, placing an order or listing a product.

1. Acceptance of these Terms

These Terms form an electronic agreement between the user and Nijee concerning access to and use of the marketplace. Your use of Nijee indicates your acceptance of the version of these Terms displayed at the relevant time.

Certain features, transactions or services may also be governed by additional marketplace policies, seller conditions, promotional terms or information displayed during the relevant process. Those terms form part of the applicable arrangement.

You should not access or use Nijee when you do not agree with these Terms or when your use would violate applicable law.

Nothing in these Terms is intended to remove, restrict or replace a right or remedy that cannot lawfully be excluded under applicable consumer or other mandatory law.

2. Important definitions

In these Terms, unless the context requires otherwise:

  • Buyer means a user purchasing or attempting to purchase a product through Nijee.
  • Seller means an independent person or business offering products through Nijee.
  • Marketplace means the Nijee website, buyer account areas, seller panels and related services.
  • Product includes permitted goods, bundled items and other permitted offerings displayed by sellers.
  • Listing means product content supplied or maintained for display through the marketplace.
  • Order means a purchase request submitted by a buyer through Nijee.
  • Transaction Price means the amount payable for an order, including applicable charges displayed before order confirmation.
  • Wallet or Balance means a ledger, promotional balance, seller balance or similar feature made available through Nijee, subject to its stated conditions.
  • Policy means a rule, guideline or public policy published by Nijee from time to time.
  • User includes visitors, customers, buyers, sellers and authorised representatives using Nijee.

3. Eligibility and authority

You must be legally capable of entering a binding agreement or must use the marketplace under the supervision and responsibility of a lawful parent, guardian or authorised representative.

A person registering, listing products, placing orders or otherwise acting for a company, partnership, proprietorship or other organisation confirms that they possess authority to act for and bind that organisation.

You must not use Nijee where applicable law, regulatory restriction, court order, sanctions or another binding restriction prohibits that use.

Nijee may request identity, authority, business, tax, banking or other verification reasonably connected with marketplace access, transactions, seller registration or compliance.

Nijee may refuse, restrict or discontinue access where a user cannot establish eligibility, authority or compliance with applicable marketplace requirements.

4. Registration, account security and information

Users must provide complete, accurate and current information when registering or using marketplace services.

  • You must not create or operate an account using another person's identity without lawful authority.
  • You must maintain accurate email, mobile, address and other relevant account information.
  • You are responsible for protecting passwords, OTPs, authentication credentials and devices used to access your account.
  • You must promptly notify Nijee of suspected unauthorised access, identity misuse or security compromise.
  • You must not sell, rent, transfer or share an account in a manner that creates security, fraud, tax or compliance risk.
  • You must cooperate with reasonable account, transaction, payout or identity-verification requests.

Activity performed through an account may be treated as activity of the registered user unless the available evidence or applicable law requires otherwise.

Nijee may require password changes, additional authentication or temporary access restriction to protect users and the marketplace.

Nijee will never require users to disclose card PINs, passwords or OTPs through ordinary support communication.

5. Nijee's marketplace role

Nijee provides technology that enables independent sellers to display products and enables buyers to discover and purchase those products.

Unless Nijee expressly identifies itself as the seller for a particular offering, the relevant independent seller is responsible for:

  • The lawful right to offer and sell the product.
  • The accuracy and completeness of the listing.
  • Product authenticity, safety and quality.
  • Mandatory labels, declarations and compliance.
  • Pricing, taxes and invoices.
  • Packaging, dispatch and fulfilment.
  • Applicable warranty and after-sales obligations.
  • Eligible cancellations, returns and refunds.

The contract for sale is generally formed between the buyer and the relevant seller when the order is accepted, subject to payment confirmation and applicable marketplace processes.

Nijee may facilitate payment collection, seller settlements, communications, customer support, logistics, promotions, complaints, returns and refunds without becoming the manufacturer or owner of every product offered by independent sellers.

Nijee may review, moderate, categorise, suspend or remove listings and accounts to support safety, platform integrity, legal compliance and user protection.

Nijee does not guarantee that every product remains continuously available or that every seller will accept every order.

6. Buyer obligations

Buyers must use Nijee lawfully, honestly and for genuine marketplace transactions.

Buyers agree to:

  • Review product descriptions, specifications, seller information, prices, delivery estimates and applicable policies before ordering.
  • Provide an accurate name, mobile number, delivery address and other order information.
  • Use only payment instruments and accounts they are authorised to use.
  • Maintain sufficient funds or payment authorisation for the selected payment method.
  • Cooperate with genuine payment, fraud, address and delivery verification.
  • Accept legitimate delivery attempts or make timely arrangements where platform features permit.
  • Inspect delivered packages and raise genuine concerns within the applicable policy period.
  • Preserve relevant packaging, accessories, serial numbers and evidence where required for an eligible return or complaint.
  • Return eligible products in the condition and manner required by the applicable return policy.
  • Communicate respectfully with sellers, delivery personnel and Nijee support.

Buyers must not:

  • Place orders without genuine intention to complete the transaction.
  • Repeatedly refuse legitimate deliveries or misuse cash-on-delivery facilities.
  • Submit false returns, fabricated evidence, fraudulent chargebacks or misleading complaints.
  • Abuse coupons, promotional balances, referral benefits or multiple accounts.
  • Attempt to pressure a seller or delivery person into an unauthorised off-platform transaction.
  • Threaten, harass, impersonate or unlawfully discriminate against another marketplace user.

Buyer misuse may result in order cancellation, benefit reversal, refund review, payment-method restriction, account suspension or other appropriate action.

7. Seller obligations

Sellers must operate lawfully, transparently and in accordance with applicable marketplace policies. Each seller remains responsible for its products, listings, business activities and fulfilment.

Sellers agree to:

  • Maintain accurate identity, business, tax, banking, pickup, return and contact information.
  • Hold all registrations, licences, permissions and approvals required for their activities and products.
  • Offer only products that they lawfully own, manufacture, distribute or are authorised to sell.
  • Maintain adequate stock and update availability accurately.
  • Provide truthful titles, descriptions, specifications, images, prices, warranty details and other product information.
  • Comply with product-safety, labelling, packaging, taxation, invoicing and consumer information requirements.
  • Process and dispatch accepted orders within applicable handling timelines.
  • Package products safely and provide correct shipment information.
  • Cooperate with cancellations, returns, replacements, refunds, investigations and support requests.
  • Protect buyer information and use it only for authorised transaction, fulfilment, compliance and support purposes.

Sellers must not:

  • List counterfeit, stolen, illegal, unsafe, recalled or prohibited products.
  • Make false claims concerning origin, certification, performance, warranty or authenticity.
  • Manipulate reviews, prices, rankings, stock, promotions or marketplace search results.
  • Include misleading contact information or use a listing to divert buyers deceptively outside Nijee.
  • Misuse customer information for unrelated marketing, harassment, resale or unauthorised disclosure.
  • Submit forged invoices, documents, tracking records, tax records or compliance evidence.

Sellers remain responsible for applicable product liability, authenticity, statutory declarations, invoices, warranties and after-sales obligations.

8. Product listings and catalogue information

Every listing must accurately and clearly represent the product that the seller intends to supply.

A listing must include, where applicable:

  • Accurate product title and category.
  • Clear description and material specifications.
  • Correct size, quantity, model and variation details.
  • Actual or representative product images.
  • Maximum retail price and selling price information.
  • Applicable tax and invoice information.
  • Manufacturer, importer or packer information.
  • Country-of-origin information where required.
  • Warranty, expiry or shelf-life information.
  • Safety warnings and usage restrictions.
  • Return eligibility and relevant exclusions.

Images, videos and descriptions must not materially misrepresent colour, quantity, dimensions, accessories, packaging or included components.

Sellers must have the necessary rights to use every product name, image, logo, description, document and other item included in a listing.

Listings must not be duplicated, keyword-stuffed, miscategorised or manipulated to obtain an unfair marketplace advantage.

Nijee may correct technical formatting, categorisation, spelling or presentation without accepting responsibility for the commercial or legal accuracy of seller-supplied content.

Nijee may reject, restrict or remove a listing where it appears unavailable, unlawful, unsafe, counterfeit, misleading, infringing, incomplete or contrary to marketplace policy.

9. Orders, acceptance and availability

Submission of an order by a buyer is a request to purchase and does not by itself guarantee final acceptance or fulfilment.

An order may remain subject to:

  • Successful payment or payment authorisation.
  • Seller acceptance and product availability.
  • Delivery-address serviceability.
  • Identity, payment or fraud review.
  • Applicable quantity or transaction limits.
  • Legal, regulatory or marketplace restrictions.

The seller must accept, process or reject an order within the operational timelines made available through the seller panel.

Nijee or the seller may reject or cancel an order before fulfilment where:

  • The product is unavailable.
  • The delivery address is incomplete or unserviceable.
  • Payment is unsuccessful, reversed or unconfirmed.
  • The displayed price contains an obvious error.
  • The order appears fraudulent or unlawful.
  • A product or transaction is restricted.
  • The seller cannot reasonably fulfil the order.
  • A technical or operational failure affects the order.

Products included in one checkout may be accepted, invoiced, dispatched, delivered, returned or cancelled separately.

Users must review order details promptly and report material errors through available account or support features.

10. Pricing, charges, taxes and invoices

Sellers are responsible for setting lawful product prices and ensuring that pricing information is accurate and not misleading.

The amount payable by a buyer will be displayed before order confirmation and may include:

  • Product selling price.
  • Applicable taxes.
  • Delivery or handling charges.
  • Platform or convenience charges where disclosed.
  • Discounts, credits or promotional adjustments.

Prices and offers may change before an order is accepted. A change will not ordinarily alter an already accepted order unless required by law, agreed by the buyer or caused by a clear error.

A seller or Nijee is not required to fulfil an order at an obviously incorrect price resulting from a typographical, catalogue, technical or system error.

Where payment has already been collected for an order cancelled because of an evident pricing error, the applicable refund process will be initiated.

Sellers are responsible for calculating, collecting, reporting and paying applicable taxes and for issuing correct tax invoices, credit notes or other required documents.

Buyers are responsible for reviewing invoices and providing any valid business or tax information required before invoicing.

11. Payments, settlements and wallet features

Payments may be processed through banks, payment gateways, payment aggregators or other authorised service providers. Their services may also be governed by separate terms.

Nijee may facilitate:

  • Payment collection from buyers.
  • Refunds and payment reversals.
  • Seller payouts and settlements.
  • Promotional credits and coupons.
  • Seller advertising or service balances.
  • Wallet-like ledger and adjustment features.

Users must provide valid payment information and use only payment methods they are authorised to use.

Nijee may delay, hold, offset, adjust or review a payment, refund or seller settlement where reasonably necessary for:

  • Cancellation, return or refund obligations.
  • Chargebacks or payment disputes.
  • Fraud prevention or transaction review.
  • Seller fees, penalties or outstanding amounts.
  • Legal, tax or regulatory compliance.
  • Account suspension or investigation.

A wallet, credit or balance feature is subject to the conditions displayed for that feature. Promotional balances may differ from cash balances and may have limited validity, use or refundability.

No wallet or balance should be treated as withdrawable unless the applicable feature expressly permits withdrawal or settlement.

Seller settlements may be calculated after applicable fees, taxes, refunds, returns, reversals, penalties, shipping charges and other valid adjustments.

Users must never share card PINs, account passwords or OTPs with sellers, delivery personnel or persons claiming to provide support.

12. Shipping, dispatch and delivery

Shipping may be performed by sellers, Nijee-enabled logistics providers or other approved delivery partners, depending on the transaction.

Sellers must:

  • Prepare and dispatch accepted orders on time.
  • Use suitable packaging for the product.
  • Apply correct labels and shipment documentation.
  • Provide accurate package weight and dimensions.
  • Hand over the correct product and quantity.
  • Comply with restricted-goods and carrier requirements.

Buyers must:

  • Provide a complete and serviceable delivery address.
  • Maintain an active delivery contact number.
  • Cooperate with genuine delivery communication.
  • Provide a delivery OTP only when receiving the package.
  • Avoid sharing login, payment or banking OTPs.

Delivery dates and timelines are estimates and may be affected by seller handling, logistics capacity, destination, weather, holidays, public restrictions, infrastructure disruption or other circumstances.

A delivery may be treated as completed based on reliable carrier records, delivery OTP, recipient acknowledgement, photograph, signature or another valid form of delivery evidence.

Buyers should promptly report a package shown as delivered but not received, or a package that appears materially damaged, tampered with or incorrect.

Failed-delivery, reattempt, return-to-origin and related charges may be allocated according to the circumstances, applicable policy and responsibility for the failure.

Responsibility for loss or damage will be assessed using available shipment records, packaging evidence, seller obligations, carrier information and applicable law.

13. Order cancellation

A buyer may request cancellation through available marketplace features while the order remains eligible for cancellation.

Cancellation may become unavailable after the order enters processing, personalisation, packaging, dispatch or another stage that cannot reasonably be reversed.

Nijee or the relevant seller may cancel an order where:

  • The product is unavailable or out of stock.
  • The seller cannot fulfil the order in time.
  • The payment fails, is reversed or remains unconfirmed.
  • The delivery address is invalid or unserviceable.
  • The displayed price contains an obvious error.
  • The order appears fraudulent, abusive or unlawful.
  • The product or transaction is legally restricted.
  • A technical or logistics issue prevents fulfilment.

A cancellation request is not final until confirmed through the platform or by Nijee support.

Where payment has been collected for a cancelled order, the applicable refund process will be initiated using the original payment method or another permitted method.

Any coupon, promotional balance, shipping charge or other benefit connected with a cancelled order will be adjusted according to the relevant offer and refund conditions.

14. Returns, replacements and refunds

Return and replacement eligibility depends on the product category, seller terms, stated return period, reason for the request, product condition and applicable law.

A product may qualify for return or replacement where it is:

  • Materially different from the confirmed listing.
  • Damaged during delivery.
  • Defective or non-functional on arrival.
  • Incorrect in model, size, colour or quantity.
  • Missing essential included parts or accessories.
  • Expired or otherwise non-compliant where applicable.

The buyer must submit the request within the applicable period and provide accurate details.

Nijee or the seller may reasonably request:

  • Photographs or video of the product and packaging.
  • Serial, batch, model or order-identification details.
  • Invoice, delivery label or related documents.
  • Technical troubleshooting where appropriate.
  • Return of the product for inspection.

Returned products should include the original product, accessories, manuals, warranty cards, certificates, promotional items and packaging where reasonably required.

A product may be ineligible for return where it is:

  • Customised, engraved or made to order.
  • Perishable or expired due to buyer delay.
  • Hygiene-sensitive and opened or used.
  • Consumed, altered, installed or damaged after delivery.
  • Missing important components or serial information.
  • Restricted by a clearly disclosed lawful exclusion.

A return request does not automatically guarantee a replacement or refund. The product and evidence may be reviewed before the request is approved.

Refund timing may depend on pickup, inspection, seller confirmation, payment-provider processing and the original payment method.

Refunds may exclude non-refundable charges where lawfully disclosed and where the relevant service has already been provided.

Nijee may reject a return or refund request that is late, unsupported, fraudulent, abusive or inconsistent with the applicable policy.

15. Reviews, feedback and user content

Users may submit reviews, ratings, questions, answers, photographs, videos and other content where the relevant feature is available.

User content must be genuine, relevant, lawful and based on actual experience where presented as such.

Users must not submit content that:

  • Is knowingly false, misleading or fabricated.
  • Is defamatory, threatening, abusive or obscene.
  • Promotes discrimination, hatred or unlawful conduct.
  • Contains another person's private information.
  • Infringes copyright, trademark or other rights.
  • Contains malware, spam or unauthorised advertising.
  • Manipulates reviews, rankings or marketplace trust.
  • Is submitted in exchange for an undisclosed benefit.

By submitting content, the user grants Nijee a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display, distribute and use that content for operating, moderating, improving and promoting the marketplace, subject to applicable privacy law.

The user confirms that they possess all rights and permissions needed for submitted content.

Nijee may review, edit for formatting, restrict or remove user content that violates marketplace rules, but is not required to pre-screen every submission.

Sellers and buyers must not offer or accept improper incentives for positive reviews or removal of genuine negative reviews.

16. Prohibited products and conduct

Users must not use Nijee for unlawful, deceptive, unsafe, abusive or unauthorised activity.

Prohibited conduct includes:

  • Listing, purchasing or facilitating illegal, stolen, counterfeit, recalled or unsafe products.
  • Offering products without required licences, registrations, approvals or declarations.
  • Money laundering, payment fraud, tax evasion or misuse of financial services.
  • Manipulation of prices, stock, rankings, reviews, search results, referrals or promotions.
  • Creating false accounts, impersonating another person or submitting forged documents.
  • Misusing returns, refunds, chargebacks, cash-on-delivery or promotional benefits.
  • Deceptively diverting a marketplace transaction outside Nijee to avoid obligations or fees.
  • Scraping, crawling, copying or accessing Nijee through unauthorised automated systems.
  • Probing security, introducing malware or attempting unauthorised access.
  • Interfering with payments, logistics, seller settlements, support or dispute processes.
  • Harassing, threatening, impersonating or unlawfully discriminating against another user.
  • Collecting, selling or misusing personal data obtained through the marketplace.

Nijee may publish or maintain additional prohibited product and restricted-category requirements. Sellers must review such requirements before listing.

Nijee may block, remove, preserve or disclose relevant information where reasonably necessary to investigate prohibited conduct or comply with law.

17. Intellectual property

Nijee's name, logos, marketplace design, software, interfaces, original graphics and platform content are protected under applicable intellectual-property laws.

Users receive a limited, revocable, non-exclusive and non-transferable right to use Nijee for its intended marketplace purposes.

Users must not:

  • Copy or reproduce protected Nijee material without permission.
  • Reverse engineer or attempt to extract source code unlawfully.
  • Create confusingly similar services, branding or interfaces.
  • Remove copyright, trademark or proprietary notices.
  • Use Nijee trademarks in a misleading or unauthorised manner.

Sellers must possess the necessary rights to use every brand name, trademark, image, video, description, document and other item included in a product listing.

Rights owners may report suspected infringement by providing:

  • Identification and contact information.
  • Proof of ownership or authority.
  • Identification of the protected material.
  • Identification of the relevant listing.
  • A clear explanation of the alleged infringement.
  • A declaration that the information is accurate.

Reports may be submitted through the Contact Us page or by emailing care@nijee.in.

Nijee may temporarily restrict or remove allegedly infringing content while reviewing a sufficiently supported notice.

False or abusive intellectual-property complaints may result in rejection and appropriate account action.

18. Account restriction, suspension and termination

Nijee may warn, restrict, suspend or terminate an account, listing, order, payout, promotion, wallet feature or other marketplace access where reasonably necessary.

Reasons may include:

  • Breach of these Terms or another policy.
  • Fraud, abuse or suspicious payment activity.
  • Security risk or unauthorised account access.
  • Counterfeit, illegal, unsafe or misleading products.
  • Repeated cancellation or fulfilment failure.
  • Unresolved buyer complaints or excessive disputes.
  • Invalid identity, tax, bank or business information.
  • Misuse of buyer or seller personal information.
  • Legal, regulatory or court requirements.

Nijee may place temporary holds on orders, refunds, settlements or balances while investigating relevant activity.

Where appropriate and legally permitted, Nijee may give the affected user an opportunity to provide clarification or appeal through available support channels.

A user whose account has been restricted must not attempt to bypass the restriction through another account, identity or business entity.

Termination does not remove obligations arising before termination, including payments, settlements, refunds, returns, indemnities, confidentiality and record-keeping duties.

Nijee may preserve account and transaction records where reasonably necessary for fraud prevention, legal compliance, dispute resolution or enforcement.

19. Support, complaints and transaction disputes

Buyers and sellers should first use the available order, return, support, ticket or communication features to raise a genuine concern.

A complaint should include sufficient information to identify and assess the issue, such as:

  • Order or transaction number.
  • Relevant product and seller details.
  • A clear description of the concern.
  • Photographs, video or documents where relevant.
  • Delivery, payment or return information.
  • The resolution reasonably requested.

Users must provide accurate information and cooperate with reasonable requests for clarification or supporting evidence.

Nijee may review available records including:

  • Listing information and order history.
  • Buyer and seller communications.
  • Payment and refund records.
  • Shipment, pickup and delivery events.
  • Images, videos and inspection reports.
  • Account and policy-compliance history.

Nijee may facilitate communication, request additional information, place temporary transaction holds or recommend an operational resolution.

A user must not submit false, fabricated, abusive or repetitive complaints or threaten another user, seller, delivery partner or support representative.

Nijee's support or mediation assistance does not prevent any party from exercising a right or remedy available under applicable law.

Transaction disputes may be closed where the user fails to provide required information within a reasonable period, subject to applicable law.

20. Platform availability and disclaimers

Nijee is provided on an “as available” and “as accessible” basis. Marketplace availability may occasionally be affected by maintenance, upgrades, technical faults, connectivity issues, security measures or events outside reasonable control.

Nijee does not guarantee that:

  • The platform will always be uninterrupted or error-free.
  • Every listing will remain continuously available.
  • Every seller will accept or fulfil every order.
  • Every user submission will be accurate or complete.
  • Every external link or third-party service will remain available.
  • Every delivery estimate will be achieved exactly.

Independent sellers remain responsible for their product claims, descriptions, quality, safety, authenticity, statutory compliance, warranties and fulfilment obligations.

Product colours, dimensions or appearance may vary slightly because of screen settings, photography, manufacturing tolerances or packaging changes, but listings must not materially misrepresent the supplied product.

Manufacturer, seller or service-provider warranties may be governed by separate terms. Nijee does not create an additional product warranty unless it expressly states otherwise for a specific offering.

Information displayed through the marketplace does not automatically constitute medical, legal, financial, technical or other professional advice.

Users should independently assess whether a product is suitable for their intended purpose and should follow manufacturer instructions and safety warnings.

21. Limitation of liability

Nothing in these Terms excludes or restricts any liability, consumer remedy or statutory obligation that cannot lawfully be excluded or restricted.

To the maximum extent permitted by applicable law, Nijee will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss, including:

  • Loss of profit or expected savings.
  • Loss of business opportunity.
  • Loss of goodwill or reputation.
  • Loss of data caused outside Nijee's reasonable control.
  • Consequences of unauthorised account sharing.
  • Loss arising from a user's unlawful or negligent conduct.

Nijee is not responsible for loss caused solely by:

  • Incorrect information supplied by a user.
  • Failure to safeguard passwords, devices or OTPs.
  • A seller's unauthorised product claim or illegal activity.
  • A buyer's misuse, alteration or unsafe use of a product.
  • A third-party payment, logistics or external service failure.
  • An event beyond Nijee's reasonable control.

Where Nijee's liability may lawfully be limited, Nijee's aggregate liability concerning a specific marketplace transaction will not exceed the amount actually paid through Nijee for the transaction giving rise to the claim.

The preceding limitation will not apply where a different minimum liability is required by mandatory law.

A user must take reasonable steps to reduce or avoid preventable loss after becoming aware of a problem.

22. Indemnity

To the extent permitted by applicable law, a user agrees to indemnify and hold harmless Nijee, its personnel and service representatives against third-party claims, penalties, losses and reasonable costs arising from that user's:

  • Breach of these Terms or another marketplace policy.
  • Violation of applicable law or regulation.
  • Infringement of another person's rights.
  • Fraud, wilful misconduct or gross negligence.
  • Product, listing, content or business activity.
  • Misuse of personal or confidential information.
  • False representation, document or complaint.

A seller's indemnity may include claims relating to:

  • Unsafe, defective, counterfeit or illegal products.
  • Incorrect labels, declarations, invoices or taxes.
  • Product recalls or regulatory action.
  • Intellectual-property infringement.
  • Injury, loss or damage caused by seller products.
  • Breach of buyer-data obligations.

Nijee may notify the relevant user of a material third-party claim and may reasonably request cooperation in its defence or resolution.

This section does not require indemnification where it would be unlawful or where the relevant loss was caused solely by Nijee's own conduct for which liability cannot lawfully be excluded.

23. Governing law and legal proceedings

These Terms and use of the Nijee marketplace are governed by the laws of India.

Before commencing formal proceedings, the parties should attempt in good faith to resolve the matter through Nijee's support or grievance channels where appropriate.

Nothing in these Terms prevents a consumer from approaching a consumer commission, regulator, authority or other forum available under applicable law.

Subject to mandatory consumer jurisdiction and other applicable legal requirements, proceedings involving Nijee may be brought before courts or tribunals having lawful territorial and subject-matter jurisdiction.

A buyer-seller dispute may also be subject to the jurisdiction available under the relevant contract, transaction location, delivery location and applicable law.

Nijee may cooperate with lawful court, regulatory, government or law-enforcement requests.

24. Force majeure and events beyond reasonable control

Nijee will not be responsible for delay, interruption or failure caused by an event beyond its reasonable control.

Such events may include:

  • Natural disaster or severe weather.
  • Fire, flood, earthquake or epidemic.
  • War, terrorism or civil disturbance.
  • Government restriction or emergency order.
  • Transport, courier or supply-chain disruption.
  • Payment-network or banking interruption.
  • Internet, hosting or telecommunications failure.
  • Cyberattack or widespread security incident.
  • Labour disruption not limited to Nijee personnel.
  • Failure of essential third-party infrastructure.

Nijee may suspend, reschedule, modify or cancel an affected service, transaction, delivery estimate or promotional activity where reasonably necessary.

Sellers and buyers must cooperate with reasonable alternative fulfilment, cancellation or refund arrangements resulting from such an event.

Nijee will take reasonable steps to reduce disruption and restore affected services when practicable.

25. Privacy and personal data

Nijee processes personal data in accordance with applicable law and the Nijee Privacy Policy .

Users should review the Privacy Policy to understand:

  • The types of information Nijee may collect.
  • How personal data may be used and protected.
  • How information may be shared for marketplace operations.
  • How cookies and technical information may be used.
  • How users may submit privacy-related requests.

Buyers acknowledge that relevant order information may be shared with the seller, payment provider, logistics provider and other service providers reasonably necessary to process and fulfil the transaction.

Sellers must use buyer personal information only for authorised marketplace purposes, including:

  • Order confirmation and fulfilment.
  • Shipping and delivery.
  • Customer support and grievance handling.
  • Returns, replacements and refunds.
  • Tax, invoice and legal compliance.
  • Fraud prevention and transaction verification.

Sellers must not use buyer information for unrelated marketing, resale, harassment, unauthorised profiling or disclosure outside permitted purposes.

Users must not publish another person's mobile number, address, banking information, identity document or other private data through reviews, listings or public marketplace content.

Users are responsible for protecting passwords, OTPs, payment credentials and devices used to access Nijee.

Privacy-related requests may require identity or authority verification before Nijee acts upon them.

26. Changes to these Terms

Nijee may update these Terms to reflect changes in:

  • Marketplace features and services.
  • Buyer or seller processes.
  • Payment, wallet or settlement arrangements.
  • Shipping, cancellation, return or refund policies.
  • Security and fraud-prevention measures.
  • Applicable legal or regulatory requirements.
  • Business, operational or technical requirements.

The updated version will be published on this page with a revised effective or last-updated date.

Where appropriate, Nijee may also provide notice through the website, user account, seller panel, registered email, mobile number or another available communication channel.

Changes will apply from the date stated in the updated Terms unless applicable law requires a different process or effective date.

Continued use of Nijee after updated Terms become effective constitutes acceptance of the revised Terms, subject to applicable law.

A user who does not agree with an updated version should stop using the affected marketplace service and may request account closure, subject to outstanding transactions and legal obligations.

27. General provisions

27.1 Entire agreement

These Terms, together with applicable policies, transaction details and feature-specific conditions, form the relevant agreement concerning use of Nijee.

27.2 Severability

If any provision is held invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary and the remaining provisions will continue to apply.

27.3 No waiver

A failure or delay in enforcing any provision does not waive the right to enforce that provision or another provision later.

27.4 Assignment and transfer

A user may not transfer marketplace rights, obligations, balances or accounts without permission where consent is legally or operationally required.

Nijee may transfer platform-related rights and obligations as part of a lawful restructuring, acquisition, merger, financing, asset transfer or business succession.

27.5 Independent parties

These Terms do not create employment, partnership, agency, franchise or joint-venture relationships between Nijee and users merely because they use the marketplace.

27.6 Electronic communication

Users consent to receiving marketplace notices, order information, policy updates and other relevant communications electronically where permitted.

27.7 Headings

Section headings are included for convenience and do not limit the meaning of these Terms.

27.8 Survival

Provisions concerning payments, settlements, refunds, intellectual property, privacy, liability, indemnity, disputes and record retention may survive account closure or termination where reasonably necessary.

27.9 Language

Nijee may make translated or simplified versions of policies available for convenience. Where permitted and where versions conflict, the version identified by Nijee as controlling will apply, subject to mandatory law.

27.10 Record evidence

Platform records, order history, payment status, shipment events, support communications and account logs may be used as evidence when assessing a marketplace transaction or dispute, subject to applicable law.
